Terms of Use for the "Domizil" Vacation Rental


1     Conclusion of Contract


The contract is deemed concluded when the respective vacation home is booked by the tenant and confirmed by the landlord via a written booking confirmation. Booking offers sent by the landlord to the guest—as opposed to independent bookings made via our website or booking portals—are non-binding. Should the tenant decide to accept such an offer, this constitutes an offer from the tenant, which the landlord may accept by issuing a written booking confirmation.


2    Payment and Prices


2.1   Prices apply as stated on the respective booking website. The quoted accommodation rates are exclusive of additional charges (cleaning, parking).


2.2  A deposit amounting to 25% of the total accommodation fees (excluding additional charges) must be received in the landlord's bank account within 7 days of booking. If the deposit is not received on time, the landlord reserves the right to terminate or withdraw from the contract, and the booked period will be released for re-booking.


2.3  The remaining balance—amounting to 75% of the total accommodation fees plus additional charges (cleaning, parking)—must be received in the landlord's bank account at least 4 weeks prior to arrival. If the remaining balance is not received on time, the landlord reserves the right to terminate or withdraw from the contract, and the booked period will be released for re-booking.


2.4  For bookings made 14 days or less prior to arrival, the full payment (100%) is due immediately.


3    Bed Linen & Towels


Bed linen and towels (one hand towel and one bath towel per person) are included. If an additional set is required, an extra usage fee of €15.00 applies.


4    Cleaning


The tenant is responsible for cleaning fees following their stay. The cleaning fee is €40. For a pet/dog, an additional flat-rate cleaning fee of €15 per night applies.


 5  Electricity Costs


The landlord is committed to resource-conscious rental practices. Standard electricity consumption is included in the rental price. Should electricity consumption be excessive (exceeding €50 per week), the landlord reserves the right to bill the tenant for the additional cost. Tenants are requested to turn off lights when not in the house and by leaving and lower the heating at night or when away.


6   Security Deposit


No security deposit is required. The landlord places great trust in guests and attaches great importance to the property being treated with care. Any additional costs arising from damage caused by the tenant will be invoiced subsequently.


 7    Cancellation Policy


7.1   No cancellation fees apply for cancellations made up to one week prior to arrival.


7.2   For cancellations made within one week of arrival, 25% of the total rental cost (accommodation fees, excluding additional charges) must be paid.


7.3   No refunds are issued for early departure.


 8     Arrival / Departure


8.1   The tenant may access the apartment from 3:00 PM. The house and apartment keys, as well as the separate parking key, are located in the key safe outside the house. The tenant will receive the code via email prior to arrival. If the code has not been received by the day before arrival, the tenant is asked to send a brief message (please check the spam folder first).


8.2  The tenant must vacate the property by 11:00 AM at the latest. It is essential that the keys are returned to the key box.


 9   Number of Guests / Transfer to Third Parties


9.1  The apartment may only be occupied by the number of persons specified in the contract (booking confirmation) and registered during the online check-in process. Children are always counted as a full person.


9.2  If the landlord discovers that more people than booked are using the premises, or that unregistered pets are present, they reserve the right to evict all persons from the property without prior notice. No rental payments will be refunded in the event of such a serious breach of contract. To avoid such issues, guests and visitors must be registered separately. 9.3 The landlord reserves the right to verify the proper use of the premises on-site at any time. An additional charge of €20 per day/night applies for each person or child not previously registered (this also applies to visitors). A charge of €30 per night applies for unregistered pets.


9.4 The tenant is not permitted to make the apartment available to third parties without the landlord's prior written conse


10    Tenant Obligations


10.1   The tenant undertakes to treat the rented property (holiday apartment, inventory, and outdoor area) with care. If damage to the apartment and/or its inventory occurs during the rental period, the tenant is obliged to report this immediately. Defects and damage discovered upon arrival must be reported at once; otherwise, the tenant shall be liable for such damage. The landlord must be granted a reasonable period of time to remedy any damage or defects.


10.2  Claims arising from complaints that are not reported immediately on-site are excluded. Complaints received by the landlord only at the end of the stay or after the tenant has vacated the holiday home are likewise excluded from compensation claims. In the event of any service disruptions, the tenant is obliged to do everything reasonably possible—within the scope of their statutory obligations—to help resolve the issue and minimize any resulting damage.


10.3  On the day of departure, all personal belongings must be removed, household waste must be disposed of in the designated containers, and dishes must be washed and stored in the kitchen cupboards.


 11  Pets


Dogs are permitted in the apartment upon prior arrangement. The fee for dogs is €15.00 per night. Dogs are not permitted on the sofa or the bed. If, during the final cleaning, it is discovered that pets have been on the furniture or that the rental premises are excessively soiled with pet hair, an additional flat-rate cleaning fee of €50.00 will be charged.


12   Liability


12.1  The landlord is liable only for damage demonstrably caused intentionally or through gross negligence by the landlord or their agents, and such liability is limited to damage that is foreseeable and typical for the contract. This limitation of liability does not apply in the event of injury to life, body, or health, or in the event of a breach of essential contractual obligations.

12.2  The landlord assumes no liability for impacts on the rental property caused by force majeure, local power or water outages, or severe weather. Similarly, no liability is accepted for unforeseeable or unavoidable circumstances—such as official orders, sudden construction work, or disturbances arising from natural or local conditions. However, the landlord will assist in resolving such issues where possible.

12.3  The landlord accepts no liability regarding the use of provided play and sports equipment. The tenant is responsible for their own travel arrangements and assumes all associated risks. The landlord is not liable for personal belongings in the event of theft or fire. The tenant is fully liable for any willful destruction or damage.


13   Waste Separation


Waste disposal regulations are determined by the local municipality. A guide to waste separation is provided in the apartment. Waste must be sorted into the following categories: general waste, plastic, glass, paper, and compost. The tenant is required to dispose of glass waste personally; appropriate recycling containers are located at Jakobsplatz, a two-minute walk from the accommodation. Plastic waste must be placed in the municipality’s yellow bags (found under the sink) and deposited at the designated waste collection area. Bins for general waste (black), paper (blue), and compost (brown) are also located at the collection area on the property grounds in front of the building. Tenants are encouraged to keep waste production to a reasonable level in the interest of sustainability. The landlord reserves the right to charge a flat fee of €50 per stay if waste separation guidelines are not followed. This also applies to excessive waste production.


14  Data Protection


The Tenant agrees to the storage and/or processing of personal data necessary within the scope of the concluded contract. All personal data will be treated with strict confidentiality in compliance with applicable data protection regulations. Please also refer to the Privacy Policy.


15   Final Provisions


15.1  Any amendments or supplements to these General Terms and Conditions, as well as their cancellation, must be made in writing to be effective. The Landlord reserves the right to amend the General Terms and Conditions for the future at any time. The General Terms and Conditions in effect at the time the contract is concluded shall apply.

15.2  Should any provision of these General Terms and Conditions, or part thereof, be or become invalid, this shall not affect the validity of these General Terms and Conditions as a whole.
